Terms of Service
Effective date: 13 October 2026 | Last updated: 13 October 2026
| Please read these Terms carefully. By creating an account, accessing, or using Nesh, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. |
1. About Nesh and these Terms
These Terms of Service ("Terms") govern your access to and use of the Nesh mobile application, websites, APIs, and related products, features, content, and services (collectively, the "Service"). Nesh is a platform for discovering, creating, sharing, and discussing news, local updates, public-interest information, videos, live streams, and other user-generated content.
The Service is operated by Nesh, with its registered office at Banglore, India ("Nesh", "we", "us", or "our"). Replace the bracketed details before publishing these Terms.
2. Eligibility
You may use Nesh only if you can legally enter into a binding agreement under applicable law. If you are below the age at which you may independently consent to use an online service in your jurisdiction, you may use Nesh only with the involvement and consent of a parent or legal guardian where required by law.
You may not use the Service if your account has previously been permanently suspended for serious or repeated violations, unless we expressly permit you to return.
3. Your account
You may need an account to use certain Nesh features. You agree to provide accurate information and keep it reasonably current.
You are responsible for safeguarding your password, OTP access, device, and account credentials.
You are responsible for activity performed through your account unless you promptly notify us of unauthorized access.
You must not impersonate another person, organization, public authority, or media outlet in a misleading way.
We may require verification, additional information, or identity checks for certain features, safety reviews, creator programs, payments, or legal compliance.
4. What you may do on Nesh
Subject to these Terms, you may use Nesh to create and manage a profile; publish posts, photos, videos, long-form content, comments, and local updates; follow other users; communicate through supported messaging features; conduct or view live streams; and use other features we make available from time to time.
Some features may depend on your location, age, device permissions, account status, verification status, or region and may not be available to every user.
5. User content and your rights
5.1 You keep ownership
You retain ownership of content that you create and submit to Nesh, including text, photographs, videos, audio, comments, messages where applicable, and live-stream content ("User Content"), subject to any rights held by third parties whose material appears in your content.
5.2 Licence you give Nesh
When you upload or publish User Content, you grant Nesh a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, process, adapt for technical purposes, distribute, communicate, display, perform, and make your User Content available as reasonably necessary to operate, improve, promote, secure, and provide the Service. This licence includes creating technical copies, previews, thumbnails, captions, translations, transcodes, and different media formats.
This licence ends when your content is deleted from our systems, except where continued retention or use is reasonably necessary for backups, legal obligations, safety, dispute resolution, enforcement, content already shared or re-shared by others, or other purposes described in our Privacy Policy.
5.3 Your responsibility for content
You represent that you have the rights and permissions needed to post your User Content and that doing so does not unlawfully infringe the rights of another person. You are responsible for the accuracy, legality, and consequences of content you publish.
6. News, citizen journalism and public-interest content
Nesh may be used to share breaking news, eyewitness accounts, local incidents, public-interest information, and commentary. Because much of this content is created by users or third parties, Nesh does not guarantee that every post is accurate, complete, verified, or current.
Clearly distinguish fact, opinion, satire, and speculation where context could otherwise mislead users.
Do not knowingly publish materially false information presented as verified fact where it could cause harm.
Do not manipulate media or omit material context in a way intended to deceive people about significant events.
Where reasonably possible, use original sources, attributable evidence, or reliable supporting material for significant factual claims.
Nesh may label, reduce distribution of, add context to, restrict, or remove content that is misleading, unsafe, unlawful, or inconsistent with our policies. Such action does not mean Nesh endorses or verifies other content that remains available.
7. Prohibited conduct and content
You must not misuse Nesh. Without limiting other policies, you may not use the Service to:
publish, threaten, promote, or coordinate unlawful violence or credible threats of physical harm;
exploit, endanger, sexualize, or facilitate abuse of children or minors;
harass, stalk, doxx, blackmail, extort, or reveal highly sensitive personal information without lawful justification;
promote hatred or dehumanizing attacks against people based on protected characteristics where prohibited by our policies or applicable law;
publish non-consensual intimate imagery, sexual exploitation material, or content that violates another person’s sexual privacy;
engage in fraud, scams, phishing, identity theft, deceptive financial schemes, or coordinated inauthentic behavior;
sell, promote, or facilitate unlawful goods, controlled substances, prohibited weapons, or other illegal transactions;
infringe copyrights, trademarks, privacy, publicity, confidentiality, or other legal rights;
upload malware, malicious code, scraping tools, or use automated systems to disrupt, overload, probe, reverse engineer, or improperly access the Service;
artificially manipulate follows, views, likes, engagement, ranking, recommendations, reporting systems, or advertising systems;
circumvent access controls, moderation actions, suspensions, rate limits, security protections, or geographic restrictions; or
use Nesh in any manner that violates applicable law or exposes Nesh or other users to material legal or security risk.
8. Live streaming
If you use live-streaming features, you are responsible for what you broadcast in real time. Do not live stream content that is unlawful, dangerously interferes with emergency operations, exposes victims or vulnerable persons to avoidable harm, reveals restricted security information, or violates another person’s rights.
Nesh may interrupt, restrict, delay, disable, preserve, or remove a live stream when reasonably necessary for safety, moderation, technical integrity, legal compliance, or enforcement of these Terms.
9. Location and hyperlocal features
Nesh may offer city, neighborhood, nearby, or hyperlocal feeds. If you choose to enable location-based features, information you publish may reveal or be associated with a general or precise location depending on the feature and permissions you select. Consider your safety before sharing real-time or sensitive location information.
You must not use location features to stalk, track, threaten, or target another person, or to disclose a private individual’s precise location without lawful justification or consent.
10. Messaging and communications
Nesh may provide direct or group messaging. You must not use messaging for spam, harassment, threats, scams, unsolicited mass outreach, or unlawful activity. We may apply automated or human safety systems to detect abuse, enforce rate limits, and protect users, consistent with applicable law and our Privacy Policy.
Do not rely on Nesh messaging as an emergency communications service. If you face an emergency, contact the appropriate emergency service or authority.
11. Moderation, reporting and enforcement
We may use automated systems, human review, trusted reports, user reports, and other signals to enforce these Terms and related policies. Depending on the circumstances, we may take actions including:
showing a warning or contextual label;
reducing content visibility or recommendation;
limiting features such as posting, comments, messaging, monetization, or live streaming;
removing content;
temporarily locking or suspending an account;
permanently disabling an account;
preserving information or reporting matters to authorities where required or permitted by law.
We may consider the severity of conduct, context, user history, risk of harm, legal obligations, and the likelihood of repeated abuse. Where required or reasonably available, we may provide a process to request review of certain enforcement decisions.
12. Intellectual property of Nesh
The Service, including Nesh software, interfaces, logos, brand elements, designs, graphics, databases, and technology, is owned by or licensed to Nesh and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of Nesh intellectual property to you.
We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose while you comply with these Terms.
13. Copyright and rights complaints
If you believe content on Nesh infringes your copyright, trademark, privacy, publicity, or other rights, you may submit a complaint through [RIGHTS REPORTING URL / EMAIL]. Your notice should identify the protected work or right, the content complained of, your contact information, the basis of your claim, and any declaration required by applicable law.
We may remove or restrict content and may take action against accounts that repeatedly infringe third-party rights.
14. Third-party services and links
Nesh may contain links to, integrations with, or content from third-party websites, services, maps, payment providers, analytics providers, social networks, app stores, or other services. We do not control third-party services and are not responsible for their independent terms, privacy practices, availability, or content.
15. Advertising, promotions and monetization
Nesh may display advertisements, sponsored content, promoted posts, branded content, subscriptions, creator tools, or other monetization features. Additional terms may apply to advertisers, creators, publishers, payment features, promotions, or revenue-sharing programs.
Users must clearly disclose paid partnerships, sponsorships, or other material commercial relationships when required by law or our policies.
16. App stores and device platforms
If you download Nesh through Apple App Store, Google Play, or another distribution platform, your use may also be subject to that platform’s terms. The platform provider is not responsible for operating Nesh except to the extent required by its own terms or applicable law.
17. Changes to the Service
We continuously develop Nesh and may add, modify, suspend, or discontinue features. We may also impose reasonable limits on storage, uploads, APIs, usage, accounts, or features to protect performance, security, users, and the Service.
Where a change materially affects your legal rights and applicable law requires notice, we will provide appropriate notice before the change takes effect.
18. Suspension and termination
You may stop using Nesh at any time and may request account deletion through the account settings or the method described in our Privacy Policy.
We may suspend or terminate access where we reasonably believe you have materially or repeatedly breached these Terms, created risk or harm, violated law, engaged in fraud or abuse, or where suspension is necessary to protect the Service or comply with a lawful request.
Provisions that by their nature should continue after termination - including intellectual-property provisions, disclaimers, liability limitations, dispute terms, and obligations relating to prior conduct - will survive termination.
19. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. Nesh does not guarantee uninterrupted availability, error-free operation, permanent storage of content, or the accuracy, reliability, completeness, or suitability of content supplied by users or third parties.
Nesh is not a substitute for professional medical, legal, financial, emergency, or other professional advice. Users should independently verify information before making decisions that could materially affect health, safety, rights, finances, or other important interests.
20. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that rule, to the maximum extent permitted by law, Nesh and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunity, or reputation arising from or related to the Service.
Where liability may lawfully be limited, Nesh’s aggregate liability for claims relating to the Service will be limited to the greater of: (a) the amount you paid directly to Nesh for the relevant Service during the 12 months before the event giving rise to the claim; or (b) INR 5,000. This limitation does not apply where prohibited by applicable consumer or other mandatory law.
21. Indemnity
To the extent permitted by applicable law, if you use Nesh for business, commercial, professional, publisher, or organizational purposes, you agree to indemnify and hold harmless Nesh and its affiliates from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful User Content, your material breach of these Terms, or your infringement of another person’s rights.
22. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Subject to any rights you have under applicable consumer law, courts located in [CITY, STATE, INDIA] will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
Before starting formal proceedings, you and Nesh are encouraged to attempt to resolve the dispute by contacting the other party and allowing a reasonable opportunity for resolution, unless urgent legal relief is necessary.

24. Privacy
Our Privacy Policy explains how Nesh collects, uses, shares, stores, and protects personal information. By using Nesh, you acknowledge that your information will be handled as described in the Privacy Policy and applicable law.
25. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service, our practices, legal requirements, or safety needs. We will update the “Last updated” date and, where required, provide additional notice. If you continue using Nesh after updated Terms take effect, you agree to the updated Terms, except where applicable law requires a different form of consent.
26. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, or by operation of law, subject to applicable law.
These Terms, together with the Privacy Policy and any feature-specific terms or policies that expressly apply to you, form the agreement between you and Nesh regarding the Service.
